Please read these Terms carefully before using the Service. This is document version “terms-2026-09-02”, the version recorded when You accept these Terms.
Definitions
Words with a capitalized initial letter have the meanings below, in the singular and the plural alike.
- Company (also “We”, “Us” or “Our”) refers to Merlin Fuchs, Alte Str. 5, 04229 Leipzig, Germany.
- Service refers to the Website and the Discord bots operated by the Company, including the earlier version of Xenon that is being retired.
- Subscription means a recurring plan or add-on purchased through the Service that grants access to paid features for a billing period.
- Terms means these Terms of Service, which form the entire agreement between You and the Company regarding the use of the Service.
- Website refers to Xenon, accessible from https://xenon.bot and https://app.xenon.bot, together with the other subdomains of xenon.bot on which the Company serves it.
- You means the individual accessing or using the Service, or the company or other legal entity on behalf of which such individual is accessing or using the Service.
Acknowledgment
By accessing or using the Service You agree to be bound by these Terms. If You disagree with any part of them, do not use the Service.
The Service requires a Discord account, and You represent that You meet the minimum age Discord requires in Your country. You further represent that You are at least 18 years old, or that a parent or guardian has consented to Your use of the Service and enters into these Terms on Your behalf. Purchases may only be made by users who are 18 or older, or by a parent or guardian acting for a minor.
Our Privacy Policy describes how We handle personal data. Where You instruct the Service to process personal data contained in Discord servers on Your behalf, You act as the controller of that data and the Company as Your processor. The Data Processing Addendum sets the terms of that processing under Article 28(3) of the General Data Protection Regulation, forms part of these Terms, states its own scope, and is accepted when You accept these Terms.
Your Account and Discord Servers
You access the Service with a Discord account. You are responsible for safeguarding that account and for all activity that occurs under it.
You represent that You have the necessary permissions for every Discord server You add to, back up, restore, copy, synchronize or otherwise process with the Service, and that doing so does not violate Discord’s Terms of Service, Developer Terms or Community Guidelines. Destructive operations such as restoring or synchronizing a server can delete channels, roles and messages; You are solely responsible for the consequences of the operations You start.
You agree not to use the Service to distribute malware or spam, to harass others, to circumvent Discord rate limits or bans, to resell the Service without permission, or to attempt to gain unauthorized access to the Service or its infrastructure.
The Template Gallery
The Service includes a public gallery of Discord server templates. Browsing it needs no account. Publishing to it is Your choice, and these terms apply when You do.
What You may publish. You may list a template only where Discord records You as its creator, which the Service checks when You submit it. You are responsible for what the template contains, including the names of its channels, roles and categories, and You warrant that publishing it infringes nobody’s rights and breaches neither Discord’s Terms of Service nor its Community Guidelines.
What publishing means. A listing is public. It is served to anyone who asks for it, indexed by search engines, and shown under Your Discord username and avatar together with a page listing everything You have published.
What You keep and what You grant Us. You keep whatever rights You hold in a template You publish. By publishing it You grant Us a non-exclusive, worldwide, royalty-free license to store, reproduce, display and distribute it through the Service, to let others create Discord servers from it, and to use it to develop and improve the automated features of the Service, including features that generate or suggest templates.
That license covers what You publish to the gallery and nothing else. It does not reach Your backups, Your chatlogs, or a template You keep to Yourself.
Deleting the listing ends the license going forward, but it cannot undo what was done while it stood: servers already created from the template stay, and a system already built or trained using it stays as it is.
Using what others published. You may use the templates in the gallery to create and set up Your own Discord servers. You may not copy the gallery or a substantial part of it, scrape it, or republish it as a catalog of Your own. What each listing contains belongs to the person who published it; the selection and arrangement of the catalog is Ours.
Moderation. We may refuse, unpublish, edit or remove a listing where it breaks these Terms, where somebody reports it, or where Our own review finds it does not belong in the gallery.
Every listing is checked automatically before it enters the gallery. Its name, its description and the names of its channels, categories and roles are classified by an automated system, described in Our Privacy Policy, and a listing the system classifies as unsuitable is rejected without a person seeing it first. Where We refuse, unpublish or remove a listing of Yours, We tell You which of these Terms it fell foul of and whether the decision was made automatically. Where the automated check rejected it, the reason it produced is on Your templates page. Write to abuse@xenon.bot if You think We got it wrong.
Anyone can report a listing through the report form or to abuse@xenon.bot; copyright complaints go to copyright@xenon.bot. Tell Us which listing and why. We confirm receipt, decide without undue delay, and tell You what We decided.
Subscriptions and Billing
Paid features are provided through Subscriptions. Subscriptions are billed in advance on a recurring basis (monthly or yearly, as selected at checkout) and renew automatically until canceled.
You may cancel a Subscription at any time, from the billing page of Your workspace, through Paddle, or by writing to billing@xenon.bot. Access to paid features remains until the end of the billing period You have paid for.
Payments are processed by Paddle, which acts as Merchant of Record for purchases made through the Service. Prices are stated at checkout and may include applicable taxes. Refunds are governed by Our Refund Policy.
We may change the price of a Subscription. We will tell You at least 30 days before a new price takes effect, and it applies only from a billing period beginning after that notice. If You do not want to pay it, cancel before it takes effect and the Subscription ends at the end of the period You have paid for.
Moving to a smaller plan, or removing an add-on, takes effect at the end of the billing period You have paid for. A feature the smaller plan does not include stops being available then, and the limits of the smaller plan apply to what You create afterwards.
Access granted through another system
Paid features can also reach a workspace through a Patreon membership, a purchase made inside Discord, or an access grant We apply Ourselves.
Where the grant comes from Patreon or from Discord, the billing relationship is Yours with them and not with Us: they take the payment, they handle canceling it, and their terms govern it. Our Refund Policy does not apply to it. We honor the grant while they tell Us it is current and end the access when it lapses.
Where We granted the access Ourselves, there is nothing to pay and nothing to cancel, and We may end it at any time.
Links to Other Websites
The Service may link to third-party websites or services that We do not control and are not responsible for. Their own terms and privacy policies apply to them.
Termination
You may stop using the Service at any time, and cancel a Subscription as described above.
We may terminate Your access on reasonable notice. We may suspend or terminate it immediately where You breach these Terms seriously enough that We cannot reasonably be expected to wait: where You use the Service unlawfully or to attack it or anybody on it, where You publish content to the gallery that We are required to remove, or where a payment You owe Us is not made. Where the breach can be cured, We will first give You a reasonable period to cure it, unless asking would be pointless or the breach is too serious for it.
Where We terminate a paid Subscription for a reason that is not Your breach, We refund the part of the period You have paid for and not received. Where We terminate it because of Your breach, We do not.
Upon termination Your right to use the Service ceases. Your artifacts are deleted as described in the Data Processing Addendum, and You are responsible for exporting anything You want to keep beforehand.
Liability
We are liable without limit for damage caused intentionally or by gross negligence, for injury to life, body or health, under the German Product Liability Act, and where We have given a guarantee.
For slight negligence We are liable only where We breach an obligation whose fulfillment makes performing this contract possible in the first place and on whose observance You may therefore reasonably rely. In that case Our liability is limited to the damage that is foreseeable and typical for a contract of this kind. We are not liable for slight negligence in any other case.
Where You are an entrepreneur within the meaning of § 14 of the German Civil Code, Our liability for slight negligence under the previous paragraph is further limited to the amounts paid for Your Subscription in the twelve months before the event giving rise to the claim, or EUR 500 if that is more.
Nothing in these Terms limits liability that cannot be limited by law, and nothing in them shifts a burden of proof to Your disadvantage. These limits apply equally to Our employees, agents and anyone else We use to perform this contract.
What We Do and Do Not Promise
We provide the Service with reasonable care and keep it available as far as We reasonably can. We do not promise that it is uninterrupted or error free, that it works with every other piece of software You use, or that it meets a requirement of Yours We have not agreed to.
Backups and other artifacts created with the Service are copies of what Discord returned at the moment they were taken. Discord’s API decides what We can read, and it changes; an artifact can therefore be incomplete through no fault of Ours, and a restore can fail on a server whose state has moved on. We do not guarantee that any artifact is complete, that it can be restored, or that a restore reproduces a server exactly. Keep Your own copies of anything You cannot afford to lose.
None of this affects Your statutory rights, in particular the rights of a consumer in respect of defects in a digital product under §§ 327 ff. of the German Civil Code, or Our liability under the section above.
Governing Law
German law governs these Terms and Your use of the Service, excluding its conflict of law rules and the UN Convention on Contracts for the International Sale of Goods. Where You are a consumer, this choice does not deprive You of the protection of the mandatory law of the country You live in.
If any provision of these Terms is invalid, the remaining provisions stay in force.
These Terms may be made available in other languages. The English text prevails in case of a dispute.
Changes to These Terms
We may change these Terms where a change in the law, in the Service or in what it costs Us to provide requires it, and where the change is reasonable for You taking Our interest and Yours into account. Price changes follow the section above instead.
A changed version carries a new version identifier. Where the change is material, We ask You to accept the new version in the Service before You go on using it, and We record that acceptance. Continuing to use the Service is not by itself agreement to a material change. If You do not want to accept it, You may stop using the Service and cancel any Subscription, and We refund the part of the period You have paid for and not received.
This page serves the version in force. We provide the text You accepted on request.
